PARC ZOOLOGIQUE DE TREGOMEUR<\/h3>\n

In these general terms and conditions of sale (hereinafter \u201cGTC\u201d), the following definitions apply: PARC ZOOLOGIQUE DE TREGOMEUR is a single-member limited liability company (EURL), registered with the Saint-Brieuc Trade and Companies Register under number 45309084700022, with share capital of \u20ac5,000.<\/p>\n

\u201cCUSTOMER\u201d: any natural or legal person with whom Parc Zoologique de Tr\u00e9gomeur enters into a contract of sale.
\n\u201cORDER\u201d: any contract binding the \u201ccustomer\u201d to Parc Zoologique de Tr\u00e9gomeur for the provision and performance of the sale of tourism products. \u201cTickethic\u201d: the dedicated portal\/platform on the Parc Zoologique de Tr\u00e9gomeur website allowing the purchase of one or more tourism products.<\/p>\n

Any order or booking of services implies unreserved acceptance of these general terms and conditions of sale, save for any other formal and express written conditions accepted by Parc Zoologique de Tr\u00e9gomeur. Every visitor must comply with the Internal Rules of Parc Zoologique de Tr\u00e9gomeur, displayed at the ticket desks and available on the park\u2019s website.<\/p>\n

<\/h4>\n

INTELLECTUAL PROPERTY RIGHTS<\/h4>\n

The customer acquires no ownership or usage right and may not use the names, signs, logos, trade marks, copyright or other signs or other literary, artistic or industrial property rights of Parc Zoologique de Tr\u00e9gomeur without its prior written consent.<\/p>\n

<\/h4>\n

ONLINE TICKETING<\/h4>\n

1.0 General provisions<\/strong><\/p>\n

1.1 These GTC apply to any online order of one or more electronic tickets purchased by the \u201ccustomer\u201d from the \u201cTickethic\u201d online ticketing service of Parc Zoologique de Tr\u00e9gomeur. These GTC may be consulted on the website.<\/p>\n

1.2 The \u201ccustomer\u201d declares that they have the capacity to enter into this contract, that is to say that they are of legal age and not under guardianship or curatorship.<\/p>\n

1.3 Placing an order implies the express and unreserved acceptance by the \u201ccustomer\u201d of all the clauses and conditions set out in these GTC.<\/p>\n

1.4 Parc Zoologique de Tr\u00e9gomeur reserves the right to amend these GTC unilaterally and at any time, and to apply them to all orders placed after the date of amendment.<\/p>\n

1.5 The entrance ticket gives access to the park on the days and during the opening hours applicable to the period chosen by the \u201ccustomer\u201d at the time of purchase.<\/p>\n

2.0 Orders<\/strong><\/p>\n

2.1 Orders for electronic tickets are subject to these GTC and to the park\u2019s internal rules. To place an order, each \u201ccustomer\u201d must identify themselves by completing a form detailing the services required. The range of offers proposed by Parc Zoologique de Tr\u00e9gomeur may be consulted on its website: www.zoo-tregomeur.com. Before finally confirming an order, the \u201ccustomer\u201d has the opportunity to check their selection (basket) and may amend it as they wish, before accepting the General Terms and Conditions of Sale. Any ticket issued is payable upon completion of the order.<\/p>\n

2.2 The order is confirmed by means of the \u201cProceed to payment\u201d button.<\/p>\n

2.3 All statements appearing in the confirmation e-mails shall be deemed accepted by the \u201ccustomer\u201d unless contested by registered letter with acknowledgement of receipt within 8 days. They may however only be contested insofar as they differ from the order placed.<\/p>\n

2.4 By keeping and\/or printing the confirmation page or the e-mail sent by the \u201cTickethic\u201d portal of the Parc Zoologique de Tr\u00e9gomeur website, the \u201ccustomer\u201d holds proof of their order.<\/p>\n

2.5 Tickets giving access to the park may be printed directly by the \u201ccustomer\u201d using their own equipment, or downloaded to a smartphone. For environmental reasons, tickets may also be shown on a smartphone and scanned at the park entrance.
\n2.6 Once the order has been confirmed and paid for, Parc Zoologique de Tr\u00e9gomeur cannot retroactively apply discounts or one-off promotional offers.<\/p>\n

2.7 Online tickets purchased through the Parc Zoologique de Tr\u00e9gomeur website are valid only for the period chosen by the \u201ccustomer\u201d when ordering. These online tickets are neither exchangeable nor refundable.<\/p>\n

2.8 Each printed online ticket carries a unique barcode\/QR code which is checked and recorded at the entrance to Parc Zoologique de Tr\u00e9gomeur using the \u201cTickethic\u201d application. It allows one customer to enter the park once only. It is not possible to be admitted to the park more than once with the same online ticket. Only the first person to present the online ticket will be admitted, that person being presumed to be the legitimate holder of the ticket.<\/p>\n

2.9 Online children\u2019s tickets may be checked at the ticket desk at the entrance to Parc Zoologique de Tr\u00e9gomeur. Proof of the children\u2019s age may be requested at any time by Parc Zoologique de Tr\u00e9gomeur staff; if no such proof is produced, the adult rate will apply.<\/p>\n

2.10 It is strictly forbidden to reproduce, duplicate or counterfeit an online ticket, to make tickets available for such purposes or to use copies of these documents. Such acts are liable to criminal prosecution, without prejudice to the damages which Parc Zoologique de Tr\u00e9gomeur would be entitled to claim from offenders in respect of the loss suffered.<\/p>\n

3.0 General rules governing the sale of electronic tickets.<\/strong><\/p>\n

3.1 No electronic ticket purchased by the \u201ccustomer\u201d for access to the park may give rise to any particular advantage in the event of heavy attendance.<\/p>\n

3.2 The descriptions of the electronic tickets presented on the Online Ticketing service specify, for each product, the services included in the price. Prices are shown in euros and are inclusive of all taxes, unless otherwise stated on the Online Ticketing service. As a general rule, and unless expressly stated otherwise, prices do not include insurance or
\nany personal expenditure (catering, drinks, souvenirs) and more generally any service not expressly mentioned on the Online Ticketing service.<\/p>\n

3.3 The prices shown on the Online Ticketing service may be amended at any time without notice, it being understood that such amendments will not apply to bookings previously
\naccepted. The age brackets defining the various ticket rates are explicitly set out on the website.<\/p>\n

3.4 Complaints: any complaint by the \u201ccustomer\u201d must be sent by registered letter with acknowledgement of receipt to Parc Zoologique de Tr\u00e9gomeur at the following address:

3.5 Cancellation or amendment:
\n\u2192 By the \u201ccustomer\u201d: tickets are neither refundable, nor exchangeable, nor transferable to another date; they may not be assigned. Should the \u201ccustomer\u201d cancel all or part of the order, for whatever reason, no refund may be claimed from Parc Zoologique de Tr\u00e9gomeur.
\n\u2192 By Parc Zoologique de Tr\u00e9gomeur: the management of Parc Zoologique de Tr\u00e9gomeur reserves the right to amend or cancel any booking in the event of force
\nmajeure, unforeseeable circumstances or specific operating constraints. Should a service be cancelled by Parc Zoologique de Tr\u00e9gomeur, the amount paid by the \u201ccustomer\u201d will be refunded to them, to the exclusion of any other compensation.<\/p>\n

4.0 Liability<\/strong><\/p>\n

4.1 Parc Zoologique de Tr\u00e9gomeur may be released from all or part of its liability by providing proof that the non-performance or improper performance of the contract is attributable either to the \u201ccustomer\u201d, or to the unforeseeable and insurmountable act of a third party or an event unconnected with the provision of the services set out in the GTC, or to a case of force majeure.
\n4.2 The \u201ccustomer\u201d shall be held liable for any damage, direct or indirect, which subscribers might cause during their presence in Parc Zoologique de Tr\u00e9gomeur, whether towards the staff and\/or customers of Parc Zoologique de Tr\u00e9gomeur, or towards any equipment made available to the customer by Parc Zoologique de Tr\u00e9gomeur.<\/p>\n

4.3 Parc Zoologique de Tr\u00e9gomeur declines all liability for damage of whatever nature. Each visitor is responsible for any damage, direct or indirect, that they might cause during their presence in the park.<\/p>\n

4.4 Parc Zoologique de Tr\u00e9gomeur may under no circumstances be held liable, in particular in the event of the loss or theft of a ticket. It may however issue a duplicate on presentation of proof of identity and of the booking date, provided that the ticket has not been used.<\/p>\n

5.0 Force Majeure<\/strong><\/p>\n

5.1 Force majeure is as defined in article 1218 of the French Civil Code: \u201cin contractual matters, there is force majeure where an event beyond the control of the obligor, which could not reasonably have been foreseen at the time of the conclusion of the contract and whose effects cannot be avoided by appropriate measures, prevents performance of the obligor\u2019s obligation\u201d. If the impediment is temporary, performance of the obligation is suspended unless the resulting delay justifies termination of the contract. If the impediment is permanent, the contract is terminated by operation of law and the parties are released from their obligations under the conditions laid down in articles 1351 and 1351-1 (of the Civil Code).<\/p>\n

5.2 In addition to the circumstances usually held by French case law to constitute force majeure, the obligations of Parc Zoologique de Tr\u00e9gomeur are automatically suspended, without it being liable for any non-performance, in the event of force majeure and, more generally, in the event of any circumstance beyond its control preventing normal performance of the order, such as: bad weather, flood, fire, strike or lock-out at Parc Zoologique de Tr\u00e9gomeur or its suppliers, supply difficulties, decisions of the administrative authorities, riots, vandalism, equipment failure, blockages or delays in transport, force majeure affecting suppliers, or any other cause leading to partial or total shutdown for Parc Zoologique de Tr\u00e9gomeur or its suppliers.
\nParc Zoologique de Tr\u00e9gomeur will inform the customer of the occurrence of such an event by e-mail or any appropriate means, as soon as it becomes aware of it, specifying the services concerned.<\/p>\n

6.0 Applicable law, complaints and disputes<\/strong><\/p>\n

6.1 These GTC are governed by French law.<\/p>\n

6.2 Any complaint arising during the performance of the services defined herein must be raised as soon as possible by the customer, on site and in an appropriate manner, so that Parc Zoologique de Tr\u00e9gomeur may seek a solution without delay. Complaints must in all cases be sent by the \u201ccustomer\u201d to Parc Zoologique de Tr\u00e9gomeur by registered letter within one month of the date on which the services were performed. The letter must state the order number together with the precise grounds for the complaint.<\/p>\n

7.0 Personal data<\/strong><\/p>\n

7.1 The information collected on the Online Ticketing service is intended for Parc Zoologique de Tr\u00e9gomeur. It is processed electronically for the purpose of handling the Customer\u2019s request and the commercial management of Parc Zoologique de Tr\u00e9gomeur, in particular: responding to requests for information made on the website; placing and managing orders;
\nsending commercial information where the customer has given their consent or where the applicable legislation so permits;
\ncompiling general statistics on website usage in order to improve the services offered by Parc Zoologique de Tr\u00e9gomeur on this website.<\/p>\n

7.2 In accordance with French Act no. 78-17 of 6 January 1978 on information technology, data files and civil liberties, the \u201ccustomer\u201d has a right of access to, rectification and deletion of the information concerning them, which the \u201ccustomer\u201d may exercise by contacting Parc Zoologique de Tr\u00e9gomeur. This is an individual right which may only be exercised by the person concerned
\nin respect of their own information: for security reasons, Parc Zoologique de Tr\u00e9gomeur must verify their identity so as to avoid disclosing confidential information
\nconcerning them to anyone else. The \u201ccustomer\u2019s\u201d data may be passed on by Parc Zoologique de Tr\u00e9gomeur to third parties for direct marketing purposes, provided that the \u201ccustomer\u201d has given their consent on the registration form they completed.<\/p>\n

7.3 The fields on the registration forms followed by an asterisk are mandatory. Failing this, Parc Zoologique de Tr\u00e9gomeur will be unable to process the registration request.<\/p>\n

8.0 Seller\u2019s insurance<\/strong><\/p>\n

Parc Zoologique de Tr\u00e9gomeur is insured:
\n\u2013 for its public liability under policy no. 41740022 with Alianz.
\n\u2013 for comprehensive business insurance under policy no. 102 602 12 504 with AXA<\/p>\n

9.0 Right of withdrawal<\/strong><\/p>\n

9.1 Article L 221-28 of the French Consumer Code: \u201cThe right of withdrawal may not be exercised for contracts\u2026 for the supply of services, accommodation other than residential accommodation, goods transport services, car hire, catering or leisure activities which must be provided on a specific date or during a specific period.\u201d Pursuant to article L 221-28 of the Consumer Code, the services covered by these general terms and conditions of sale are not subject to the right of withdrawal set out in article L 221-18 of the Consumer Code<\/p>\n

SALES AT THE TICKET DESK<\/h4>\n

10.0 Sales at the ticket desk<\/strong><\/p>\n

Sale of individual entrance tickets: the range of offers proposed by Parc Zoologique de Tr\u00e9gomeur may be consulted on the
\nrates board at the park\u2019s ticket desks or on the website www.zoo-tregomeur.com.
\nIndividual tickets\/services are sold:
\n\u2013 at the Parc Zoologique de Tr\u00e9gomeur ticket desk, for one or more tickets to be used the same day. The sale is firm and final for the customer, who may cancel or amend it only under the conditions set out in these general terms and conditions of sale. It is firm and final for Parc Zoologique de Tr\u00e9gomeur once confirmed, except in cases of force majeure and\/or bad weather.<\/p>\n

11.0 Prices<\/strong><\/p>\n

Prices are those displayed at the reception of Parc Zoologique de Tr\u00e9gomeur and on its website. They are expressed in euros inclusive of all taxes. Where the rate depends on the children\u2019s age, that age is taken into account on the first day on which the service is provided. Proof of the children\u2019s age may be requested at any time by Parc Zoologique de Tr\u00e9gomeur staff; if no such proof is produced, the adult rate will apply.<\/p>\n

11.1 payment terms<\/p>\n

\u2013 sales at the ticket desk: payment is made at the time of ordering, by bank card, holiday vouchers (ch\u00e8ques vacances) or in cash.<\/p>\n

12.0 Conditions of service<\/strong><\/p>\n

Sales made at the ticket desk give the right to immediate access to the park for the same day: the ticket
\nmay not be used for a later date. A disabled visitor rate applies exclusively to purchases made directly at the park\u2019s ticket desk and for the same day: the conditions for this rate are set out on the Parc Zoologique de Tr\u00e9gomeur website.<\/p>\n

13.0 Complaints<\/strong><\/p>\n

Any complaint must be sent by registered letter with acknowledgement of receipt no later than 8 days after the date of the visit, failing which it will be time-barred.<\/p>\n

14.0 Characteristics of tickets \/ Services<\/strong><\/p>\n

\u2013 Cancellation by the customer. Tickets are neither refundable, nor exchangeable, nor transferable to another date; they may not be assigned. Should the customer cancel all or part of the sale, for whatever reason, no refund may be claimed from the seller.<\/p>\n

15.0 Amendment or cancellation by Parc Zoologique de Tr\u00e9gomeur <\/strong><\/p>\n

The management of Parc Zoologique de Tr\u00e9gomeur reserves the right to amend or cancel any booking in the event of force majeure, unforeseeable circumstances or specific operating constraints. Should a service be cancelled by Parc Zoologique de Tr\u00e9gomeur, the amount paid by the customer will be refunded to them, to the exclusion of any other compensation.<\/p>\n

16.0 Right of withdrawal<\/strong><\/p>\n

Article L 221-28 of the French Consumer Code: \u201cThe right of withdrawal may not be exercised for contracts\u2026 for the supply of services, accommodation other than residential accommodation, goods transport services, car hire, catering or leisure activities which must be provided on a specific date or during a specific period.\u201d Pursuant to article L 221-28 of the Consumer Code, the services covered by these general terms and conditions of sale are not subject to the right of withdrawal set out in article L 221-18 of the Consumer Code.<\/p>\n

17.0 Liability<\/strong><\/p>\n

Parc Zoologique de Tr\u00e9gomeur may under no circumstances be held liable for non-performance or improper performance of the sale attributable to the customer or to the unforeseeable and insurmountable act of a third party.<\/p>\n

18.0 Force Majeure<\/strong><\/p>\n

19.0 Seller\u2019s insurance<\/strong><\/p>\n

Parc Zoologique de Tr\u00e9gomeur is insured:
\n\u2013 for its public liability under policy no. 417 400 22 with ALIANZ.
\n\u2013 for comprehensive business insurance under policy no. 102 604 125 04 with AXA.<\/p>\n

<\/h4>\n

EXTRACT FROM THE FRENCH TOURISM CODE<\/h4>\n

20.0 Extract from the French Tourism Code<\/strong><\/p>\n

20.1 Article R211-3 as amended by Decree no. 2009-1650 of 23 December 2009 \u2013 art. 1
\nSubject to the exclusions provided for in the third and fourth paragraphs of article L.211-7, any offer and any sale of travel or holiday services shall give rise to the provision of appropriate documents meeting the rules laid down in this section. Where air transport tickets or scheduled-service transport tickets are sold without any services connected with that transport, the seller shall issue the buyer with one or more passenger tickets for the whole journey, issued by the carrier or under its responsibility. In the case of on-demand transport, the name and address of the carrier on whose behalf the tickets are issued must be stated. Separate invoicing of the various components of a single package does not release the seller from the obligations imposed on it by the regulatory provisions of this section.<\/span><\/p>\n

20.2 Article R211-3-1 as amended by Decree no. 2016-1278 of 29 September 2016 \u2013 art. 1 (V)
\nThe exchange of pre-contractual information or the provision of the contractual conditions shall be made in writing. It may be done electronically under the conditions of validity and performance laid down in articles 1125 to 1127-6, 1176 and 1177 of the Civil Code. The seller\u2019s name or company name and address shall be stated, together with the details of its registration in the register provided for in point (a) of article L. 141-3 or, where applicable, the name, address and registration details of the federation or union referred to in the second paragraph of article R. 211-<\/p>\n

20.3 Article R211-4 created by Decree no. 2009-1650 of 23 December 2009 \u2013 art. 1
\nBefore the contract is concluded, the seller must provide the consumer with information on the prices, the dates and the other components of the services supplied in connection with the trip or holiday, such as:
\n\u2192 the destination, the means, characteristics and categories of transport used;
\n\u2192 the type of accommodation, its location, its level of comfort and its main characteristics, its approval and its tourist classification under the regulations or customs of the host country;
\n\u2192 the catering services offered;
\n\u2192 a description of the itinerary in the case of a tour;
\n\u2192 the administrative and health formalities to be completed by nationals or by nationals of another Member State of the European Union or of a State party to the Agreement on the European Economic Area, in particular when crossing borders, together with the time required to complete them;<\/p>\n

the visits, excursions and other services included in the package or possibly available at extra cost;
\nthe minimum or maximum size of the group required for the trip or holiday to take place and, where the trip or holiday depends on a minimum number of participants, the deadline for informing the consumer in the event of cancellation of the trip or holiday; this date may not be set at less than twenty-one days before departure; the amount or percentage of the price to be paid as a deposit on conclusion of the contract, together with the timetable for payment of the balance; the arrangements for price revision as provided for in the contract pursuant
\nto article R. 211-8;
\nthe contractual cancellation conditions;
\nthe cancellation conditions set out in articles R. 211-9, R. 211-10 and R. 211-11; information concerning the optional taking out of an insurance contract covering the consequences of certain cases of cancellation, or of an assistance contract covering certain
\nspecific risks, in particular repatriation costs in the event of accident or illness; where the contract includes air transport services, the information provided for in articles R. 211-15 to R. 211-18 for each flight segment.<\/p>\n

20.4 Article R211-5 as amended by Decree no. 2009-1650 of 23 December 2009 \u2013 art. 1
\nThe prior information given to the consumer is binding on the seller, unless the seller has expressly reserved therein the right to amend certain elements of it. In that case, the seller must clearly state to what extent such amendment may be made and to which element. In any event, amendments to the prior information must be communicated to the consumer before the contract is concluded.<\/p>\n

20.5 Article R211-6 as amended by Decree no. 2016-1278 of 29 September 2016 \u2013 art. 1 (V)
\nThe contract concluded between the seller and the buyer must be in writing, drawn up in duplicate, one copy of which is given to the buyer, and signed by both parties. Where the contract is concluded electronically, articles 1125 to 1127-6, 1176 and 1177 of the Civil Code apply. The contract must contain the following clauses:
\nthe name and address of the seller, of its guarantor and of its insurer, together with the name and address of the organiser;
\nthe destination or destinations of the trip and, in the case of a split holiday, the various periods and their dates;<\/p>\n

the means, characteristics and categories of transport used, the dates and places of departure and return; the type of accommodation, its location, its level of comfort and its main characteristics and its tourist classification under the regulations or customs of the host country; the catering services offered; the itinerary in the case of a tour; the visits, excursions or other services included in the total price of the trip or holiday; the total price of the services invoiced, together with details of any revision of that invoicing under the provisions of article R. 211-8; details, where applicable, of the charges or taxes relating to certain services, such as landing, disembarkation or embarkation taxes at ports and airports, or tourist taxes where these are not included in the price of the service or services supplied; the timetable and arrangements for payment of the price; the final payment made by the buyer may not be less than 30% of the price of the trip or holiday and must be made upon delivery of the documents enabling the trip or holiday to be taken; the particular conditions requested by the buyer and accepted by the seller;<\/p>\n

the arrangements under which the buyer may submit a complaint to the seller for non-performance or improper performance of the contract, such complaint to be sent as soon as possible, by any means allowing an acknowledgement of receipt to be obtained from the seller, and, where applicable, reported in writing to the travel organiser and to the service providers concerned; the deadline for informing the buyer in the event of cancellation of the trip or holiday by the seller where the trip or holiday depends on a minimum number of participants, in accordance with the provisions of point 7 of article R. 211-4; the contractual cancellation conditions; the cancellation conditions provided for in articles R. 211-9, R. 211-10 and R. 211-11; details of the risks covered and of the amount of the guarantees under the insurance contract covering the consequences of the seller\u2019s professional liability; details of the insurance contract covering the consequences of certain cases of cancellation taken out by the buyer (policy number and name of the insurer), together with details of the assistance contract covering certain specific risks, in particular repatriation costs in the event of accident or illness; in that case, the seller must give the buyer a document setting out at least the risks covered and the risks excluded; the deadline for informing the seller in the event of assignment of the contract by the buyer; an undertaking to provide the buyer, at least ten days before the scheduled date of departure, with the following information:<\/p>\n

a) the name, address and telephone number of the seller\u2019s local representative or, failing that, the names, addresses and telephone numbers of local bodies able to help the consumer in the event of difficulty or, failing that, the telephone number allowing emergency contact to be made with the seller;
\nb) for trips and holidays of minors abroad, a telephone number and address allowing direct contact to be made with the child or with the person responsible for them on site; the clause providing for termination and refund without penalty of the sums paid by the buyer in the event of failure to comply with the information obligation provided for in point 13 of article R. 211-4; an undertaking to provide the buyer, in good time before the start of the trip or holiday, with the departure and arrival times.
\n20.6 Article R211-7 as amended by Decree no. 2009-1650 of 23 December 2009 \u2013 art. 1 The buyer may assign the contract to an assignee who meets the same conditions as the buyer for taking the trip or holiday, for as long as the contract has not taken effect. Unless more favourable terms are stipulated for the assignor, the latter must inform the seller of their decision by any means allowing an acknowledgement of receipt to be obtained, no later than seven days before the start of the trip. In the case of a cruise, this period is extended to fifteen days. Such assignment is in no case subject to the seller\u2019s prior authorisation.<\/p>\n

20.7 Article R211-8 as amended by Decree no. 2009-1650 of 23 December 2009 \u2013 art. 1 Where the contract expressly provides for the possibility of price revision, within the limits laid down in article L. 211-12, it must state the precise methods of calculating price variations, both upward and downward, and in particular the amount of transport costs and related taxes, the currency or currencies that may affect the price of the trip or holiday, the portion of the price to which the variation applies, and the exchange rate of the currency or currencies used as a reference when the price stated in the contract was set.<\/p>\n

20.8 Article R211-9 as amended by Decree no. 2009-1650 of 23 December 2009 \u2013 art. 1
\nWhere, before the buyer\u2019s departure, the seller is compelled to amend one of the essential elements of the contract, such as a significant price increase, and where the seller fails to comply with the information obligation referred to in point 13 of article R. 211-4, the buyer may, without prejudice to any claims for compensation for loss suffered, and after being informed thereof by the seller by any means allowing an acknowledgement of receipt to be obtained:
\n\u2013 either terminate the contract and obtain immediate refund of the sums paid, without penalty;
\n\u2013 or accept the amendment or the substitute trip proposed by the seller; an amendment to the contract setting out the changes made is then signed by the parties; any price reduction is deducted from any sums still owed by the buyer and, if the payment already made by the buyer exceeds the price of the amended service, the excess must be refunded to them before their departure date.<\/p>\n

20.9 Article R211-10 as amended by Decree no. 2009-1650 of 23 December 2009 \u2013 art. 1 In the case provided for in article L. 211-14, where, before the buyer\u2019s departure, the seller cancels the trip or holiday, it must inform the buyer by any means allowing an acknowledgement of receipt to be obtained; the buyer, without prejudice to any claims for compensation for loss suffered, obtains from the seller the immediate refund of the sums paid,
\nwithout penalty; in that case the buyer receives compensation at least equal to the penalty they would have borne had the cancellation been made by them on that date. The provisions of this article in no way preclude the conclusion of an amicable agreement whereby the buyer accepts a substitute trip or holiday proposed by the seller.<\/p>\n

20.10 Article R211-11 Where, after the buyer\u2019s departure, the seller is unable to provide a major part of the services provided for in the contract representing a significant percentage of the price paid by the buyer, the seller must immediately take the following measures, without prejudice to any claims for compensation for loss suffered: either offer services to replace those provided for, bearing any additional cost and, if the services accepted by the buyer are of a lower standard, refunding the buyer the price difference on their return; or, if it is unable to offer any replacement service or if these are refused by the buyer on valid grounds, provide the buyer, at no extra cost, with transport tickets for their return under conditions that may be regarded as equivalent, to the place of departure or to another place accepted by both parties.
